DMCA Policy

Trading Meme Coins ("TMC", "we", "us", "our") respects the intellectual property rights of others and expects users of the TMC Platform to do the same.

In accordance with the United States Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512, and similar copyright laws in other jurisdictions, we will respond expeditiously to claims of copyright infringement committed using the TMC Platform that are reported to our designated copyright agent.

This DMCA Policy describes how we handle claims of copyright infringement related to content available on the TMC Platform, including but not limited to user-generated token names, ticker symbols, images, descriptions, social links, and comments.


1. Reporting Copyright Infringement

If you are a copyright owner, or an agent thereof, and believe that any content on the TMC Platform infringes your copyrights, you may submit a notification pursuant to the DMCA by providing our designated copyright agent with the following information in writing:

  1. Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, provide a representative list of such works.
  2. Identification of the allegedly infringing material that is to be removed or access disabled, and information reasonably sufficient to permit us to locate the material. This should include:
    • The specific URL on the TMC Platform where the material is located (e.g., the token page URL, comment URL, or asset URL);
    • For tokens, the mint address (Solana base58 public key);
    • Screenshots or other evidence as relevant.
  3. Your contact information: full legal name, mailing address, telephone number, and email address.
  4. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.
  6. Your physical or electronic signature (typing your full legal name is sufficient).

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.


2. Counter-Notification

If you believe that material you submitted to the TMC Platform was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us by providing the following information in writing:

  1. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
  2. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  3. Your contact information: full legal name, mailing address, telephone number, and email address.
  4. A statement that you consent to the jurisdiction of the courts of the British Virgin Islands (or, if you are located outside the BVI, of any judicial district in which the TMC operator may be found), and that you will accept service of process from the person who provided the original DMCA notice, or an agent of such person.
  5. Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward it to the original complaining party. If the original complaining party does not file a court action seeking an injunction within 10 to 14 business days of receiving the counter-notification, we may restore the removed material.


3. Repeat Infringers

In accordance with the DMCA and other applicable laws, TMC has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the access privileges of wallets, users, or token creators who are determined to be repeat infringers.

A "repeat infringer" is any user whose wallet has been the subject of two (2) or more substantiated DMCA takedown notices that have not been successfully countered.

We may also, at our sole discretion, limit access to the TMC Platform and/or terminate the access of any user who infringes intellectual property rights of others, whether or not there is any repeat infringement.


4. On-Chain Limitations

You acknowledge and accept that the Solana blockchain is a public, decentralized, and immutable ledger. TMC cannot remove or modify any on-chain data, including:

  • Token mint accounts
  • Token metadata stored on-chain or on IPFS
  • Transaction history
  • Wallet activity records

What we can do upon a valid DMCA notification:

  • Remove or hide the infringing token from the TMC Platform user interface (the token will no longer appear in listings, search, or trending).
  • Disable trading of the infringing token through the TMC Platform.
  • Remove infringing comments or user-generated text content.
  • Ban the offending wallet from creating new content.

What we cannot do:

  • Delete the token from the Solana blockchain.
  • Recover tokens already purchased by users.
  • Remove the token from third-party explorers (e.g., Solscan, SolanaFM) or other interfaces.
  • Reverse on-chain transactions.

You should pursue takedowns directly with third-party services (such as decentralized exchanges, explorers, or wallet providers) for content that exists outside the TMC Platform's control.


5. Trademark Infringement

This DMCA Policy covers copyright claims only. For trademark infringement claims (e.g., a token using a registered brand name or logo without authorization), please refer to our Trademark Guidelines and submit your claim using the procedure described therein.


6. Other Jurisdictions

While this policy is primarily based on the U.S. DMCA, we will respond to valid copyright takedown notices from other jurisdictions where required by Applicable Law, including but not limited to:

  • The EU Copyright Directive (2019/790)
  • The UK Copyright, Designs and Patents Act 1988
  • Comparable copyright laws in other countries

Notices from non-U.S. jurisdictions should follow the procedure described in Section 1 above and clearly identify the applicable law under which the notice is made.


7. Modifications

We may modify this DMCA Policy at any time. Changes will be announced on the TMC Platform with the updated "Last Updated" date at the top of this document.
